Terms And Condition

1) Important Terms & Conditions:-

A. Our one way journey packages mostly include charges for Toll, Fuel, Driver Allowance & A/C.

B. The packages based on per km rate (e.g. Outstation, Return trips, Local Trips) do not include Toll, Driver night allowance charges.

C. In some packages wherever it has been mentioned these may be excluded, Kindly read Service & package description carefully.

D. Parking charges(if any) would be paid by the customer at actual. Inter-state taxes, permit fees (which are incurred rarely on certain highways) would be extra.

E. Airport Pickups (where advance payment is not made) you must call customer care or cab drive(number is provided in the SMS) an inform about your arrival. Because driver will not enter the parking lot unless he gets the confirmation about arrival. We at Shmmss will also track the flight arrival and instruct him for the same.

F. Airport Pickup with Nameboard/Placard then advance payment is mandatory.

2) Cancellation And Refund Charges for reservation

A. Cancellations 6 to 24hrs before the pickup, then it will attract NO cancellation charges.

B. On the spot cancellation when cab arrived to pick you up (Or No intimation for cancellation, also called No Show) then 50% cancellation charges will be levied on the gross price.

C. The booking may be canceled and cancellation charges will be payable after three unsuccessful attempt to reach you.

D. Shmmss Cabs maximum liability is limited to refund of the amount of rental charged against the particular transaction.

3) Payment And Billing

A. Electronic payment receipt can be obtained via SMS & Email, if you call Shmmss Cabs customer care.

B. Our system auto generate invoice and send it optionally by Email/mail at the end of journey.

C. In case you have paid only paid booking amount but not full advance payment then Shmmss Cabs will give you only “Provisional Confirmation" via email, you will be allocated a cab only subject to your availability on phone normally 3-12hrs before the pickup time.

D. Shmmss Cabs reserves the rights to deny cab to any booking where advance payment is not made.

E. The payment has to be made in Cash only (If not already paid in Bank), at the start of the journey directly to the Driver.

F. All advance online or cheque payment must be made 24 hours before the start of the journey, so our back–end team have sufficient time to confirm the payment.

4) Services

A. In case it’s a air-port pick up on arrival, kindly call our customer care before boarding your flight and give all the details, it will help us for arranging a cab for you.

B. If the cab f particular category booked by you in advance is not available at the time of your journey, we will send an alternative cab of same or higher category e.g. instead Indica we will send Swift/Indigo or even SUV like Innova/Enjoy. And in case of acute shortage we may send cab of lower category too.

C. For one-way pick/drop only one halt is allowed( not exceeding 30 mins). Any extra Halt may cost extra.

D. Our cab services are km rental-based hence all one-way packages are limited time based packages depending on intercity distance.

E. Cab rental booking must be preferably made 24 hours in advance and in case of urgent / short-notice booking, it depends on availability of driver and cab at that point of time.

F. For per Km packages, car rental will be charged with the car rental office as the start and end point.

G. Car rental tariffs are subject to change without prior notice.

H. For Airport or Bus/Rail Station Drops, if the customer misses the flight/Train/Bus due to any delays then Shmmss Cabs is not liable for compensating for the same.

I. During peak hours or in case of shortage. Shmmss Cabs may act as a facilitator between the customer & a local cab service provider (Vendor). Wherein the service is provided by the one of our our select vendors using his own car & driver. In many cases you may have to pay directly to the vendor/Driver as advised by our customer care executive.

J. Shmmss Cabs make every effort to verify the select vendors based on are reliability, background and history of their services. But in certain events vendors may use cabs not already verified by the Shmmss Cabs Services. Claims if any will be settled as per existing laws in India by the concerned insurance company or the owner of the cab.

K. If extra hours are logged, the next package rate with extra hours and kilometers will be charged as applicable.

L. If the cab has been retained beyond 24:00 hours / mid night, then night halt charges will be applicable.

M. Driver charges / toll chargers and any inter-city charges / taxes are applicable if the car travels beyond city / corporation limits.

N. In the event of any accident or damage to the vehicle, or theft, the passenger / customer is required to inform our customer care immediately and should also get First Information Report filed at the nearest police station at their own cost.

O. Any parking, traffic or driving violation, where are not caused due to driver’s mistakes / negligence will be collected from the customer with 10% surcharge.

5) Other Terms & Conditions

A. The Customer agrees and acknowledges that the use of the services offered by Shmmss Cabs Services is at the sole risk of the Customer and that Shmmss Cabs Services disclaims all representations and warranties of any kind, whether express or implied as to condition, suitability, quality, merchantability and fitness for any purposes are excluded to the fullest extent permitted by law.

6) Without prejudice to the above, Shmmss Cabs Services makes no representation or warranty that:

A. The service will meet your requirements.

B. The service will be uninterrupted, timely, secure, or error-free.

C. Without prejudice to the above, Shmmss Cabs Services shall not be liable for any direct or indirect loss or damage which may be suffered by the Customer as a result of any failure by Shmmss Cabs Services to provide a cab to the Customer within any stipulated time even if Shmmss Cabs Services has agreed to so provide the cab or even if the Customer has advised Shmmss Cabs Services of the possibility that any such loss or damage would result if the cab is not provided at all or within the stipulated time.

D. The Customer shall indemnify Shmmss Cabs Services from and against and in respect of any or all liabilities, losses, charges and expenses (including legal fees and costs on a full indemnify basis) claims, demands, actions and proceedings which Shmmss Cabs Services may incur or sustain directly or indirectly from or by any reason of or in relation to the use or purposed use of the Services by the Customer and shall pay such sums on demand.

F. Shmmss Cabs Services is hereby authorized to use the location based information provided by any of the telecommunication companies when the Customer uses the mobile phone to make a cab booking. The location based information will be used only to facilitate and improve the probability of locating a cab for the Customer.

G. Shmmss Cabs Services shall be entitled to disclose to all companies within the Shmmss Cabs Services or any of its authorized chauffeurs or any government body as so required by the law or by directive or request from such government body or any third party, the particulars of the Customer in the possession of Shmmss Cabs Services in any way as Shmmss Cabs Services, in its absolute discretion, deems fit or if it considers it in its interests to do so.

H. Shmmss Cabs shall be entitled at any time without giving any reason or prior notice to terminate the booking of cab s done by the Customer.

I. For passenger security purpose all vehicles registered with Shmmss Cabs may be continuously tracked using GPS application.

J. Shmmss Cabs have right to use the customer contact information for informing you about our promotional offers and for marketing purpose.

K. Shmmss Cabs does not warrant that this site, its servers, or e-mail sent from Shmmss Cabs are free of viruses or other harmful components. Shmmss cabs will not be liable for any damages of any kind arising from the use of this site, including, but not limited to direct, indirect, incidental, punitive, and consequential damages.
